1. Acceptance of Terms

Welcome to Savendralto. By accessing and using this website and the services offered through it, you agree to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

These Terms of Use constitute a legally binding agreement between you (hereinafter, the "User") and Savendralto (hereinafter, the "Platform", "we" or "our"). Use of this website implies full and unreserved acceptance of all provisions included in these Terms of Use.

2. Service Description

Savendralto is a digital platform that facilitates the exchange of goods and services between colonia neighbors without monetary transactions. Our service includes:

  • A digital space for users to post exchange offers for books, tools and skill-based services
  • Communication tools to facilitate contact between users interested in making exchanges
  • Rating and reputation system to foster trust in the community
  • Information and resources about collaborative economy and modern barter

Savendralto acts exclusively as a technological intermediary that facilitates connection between users. We are not part of any exchange transaction between users and have no control over the quality, safety, legality or availability of goods or services offered, nor over users' ability to complete an exchange transaction.

3. Eligibility and Registration

To use the full services of Savendralto, users must:

  • Be at least 18 years of age or have consent from a parent or legal guardian
  • Provide truthful, accurate and complete information during the registration process
  • Keep their contact information and profile updated
  • Be responsible for maintaining the confidentiality of their account and password
  • Immediately notify Savendralto of any unauthorized use of their account

Savendralto reserves the right to refuse service, close accounts or cancel registrations at its sole discretion, especially in cases of violation of these Terms of Use or inappropriate behavior on the platform.

4. User Obligations

By using Savendralto, you agree to:

  • Use the platform only for lawful purposes and in accordance with these Terms of Use
  • Not post false, misleading, defamatory, obscene or illegal content
  • Not offer in exchange stolen, counterfeit, dangerous or illegally possessed goods
  • Not use the platform for commercial activities or for monetary profit purposes
  • Respect the intellectual property rights of third parties and Savendralto
  • Not engage in activities that could damage, disable or overload the platform's infrastructure
  • Not attempt to gain unauthorized access to other users' accounts or restricted areas of the platform
  • Treat other users with respect and courtesy, refraining from abusive or harassing behaviors
  • Comply with all applicable local, state and federal laws when making exchanges

Failure to comply with these obligations may result in immediate suspension or termination of your account without prior notice.

5. User Content

Users may post, upload or share content on Savendralto, including item descriptions, photographs, reviews and comments (hereinafter, "User Content"). By posting User Content, you:

  • Represent and warrant that you are the owner of the content or have all necessary rights to post it
  • Grant Savendralto a worldwide, non-exclusive, royalty-free license to use, modify, reproduce and distribute such content in connection with the platform's operation
  • Accept that you are solely responsible for the content you post and the consequences of its publication
  • Understand that Savendralto does not endorse or guarantee the veracity of any User Content

Savendralto reserves the right to remove any User Content that, at our sole discretion, violates these Terms of Use, is offensive or inappropriate, or for any other reason. However, we have no obligation to monitor content posted by users.

6. Transactions and Exchanges

Savendralto facilitates connection between users to make exchanges, but is not part of any transaction. Users are responsible for:

  • Evaluating the convenience and safety of any proposed exchange
  • Verifying the identity and reputation of other users before agreeing to an exchange
  • Meeting in safe and public places to make exchanges in person
  • Inspecting goods before completing an exchange
  • Resolving any disputes directly with the other party of the exchange

Savendralto does not verify the quality, safety or legality of items offered, nor the veracity of descriptions provided by users. We do not guarantee that exchanges will be completed successfully. Users make exchanges at their own risk and responsibility.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Savendralto and its directors, employees, agents and affiliates will not be liable for any direct, indirect, incidental, special, consequential or punitive damages resulting from:

  • The use or inability to use the platform
  • Any transaction or exchange between users
  • The behavior or content of third parties on the platform
  • Unauthorized access, use or alteration of your transmissions or content
  • Errors, omissions or inaccuracies in platform content
  • Personal injury or property damage resulting from access to or use of the platform
  • Loss of data, profits or anticipated savings

Savendralto provides the platform "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or non-infringement.

8. Indemnification

You agree to indemnify, defend and hold harmless Savendralto, its officers, directors, employees, agents, suppliers and affiliates from and against any claim, liability, damage, loss, cost or expense, including reasonable attorneys' fees, arising from or related to:

  • Your use of the platform or services
  • Your violation of these Terms of Use
  • Your violation of any third party rights, including intellectual property rights
  • Any User Content you post on the platform
  • Any transaction or exchange made through the platform

9. Intellectual Property

The content, features and functionality of Savendralto, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations and software, are the property of Savendralto or its content suppliers and are protected by copyright, trademark and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, publicly perform, republish, download, store or transmit any material from our website without prior written permission from Savendralto, except when expressly permitted by these terms or applicable legislation.

10. Modification of Terms

Savendralto reserves the right to modify these Terms of Use at any time. We will post the revised version on this page with the corresponding update date. Changes will take effect immediately after their publication.

It is your responsibility to periodically review these Terms of Use. Continued use of the platform after publication of changes constitutes your acceptance of such changes. If you do not agree with the modified terms, you must stop using the platform.

11. Termination

Savendralto may suspend or terminate your access to the platform immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Use.

You may discontinue use of the platform at any time. If you wish to close your account, you can contact us at contact@savendralto.com. Upon termination of your account, your right to use the platform will cease immediately.

All provisions of these Terms of Use that by their nature should survive termination will survive, including without limitation intellectual property provisions, limitation of liability and indemnification.

12. Applicable Law and Jurisdiction

These Terms of Use shall be governed and interpreted in accordance with the laws of the United Mexican States, without giving effect to any conflict of laws principle.

Any dispute arising from or related to these Terms of Use or the use of the platform will be subject to the exclusive jurisdiction of competent courts located in Mexico City, CDMX, Mexico. You expressly consent to the personal jurisdiction of such courts.

13. General Provisions

If any provision of these Terms of Use is deemed invalid or unenforceable, such provision will be eliminated or limited to the minimum necessary, and the remaining provisions of these Terms of Use will remain in full force and effect.

Our failure to enforce any right or provision of these Terms of Use will not be considered a waiver of such rights. These Terms of Use constitute the complete agreement between you and Savendralto regarding the use of the platform and supersede all prior and contemporaneous agreements, whether written or oral.
